Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the CityTransit mobile application and the thecitytransit.com website (together, “CityTransit”, the “App” or the “Service”), operated by Vasani Technologies Inc. (“we”, “us”, “our”). By downloading, accessing, or using CityTransit, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

CityTransit provides public transit information - including nearby stops, live vehicle arrivals, trip planning, route maps, service alerts, and arrival alarms - for participating transit agencies in 160+ cities. CityTransit is an independent, unofficial companion app and is not affiliated with, endorsed by, or operated by any transit agency, city, or transportation authority.

2. Eligibility

You must be at least 13 years old to use CityTransit. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.

3. Data Accuracy Disclaimer

Transit data displayed in CityTransit - including arrival times, vehicle positions, schedules, routes, and service alerts - is sourced from public transit agency feeds (GTFS and GTFS-realtime) and other third-party providers. This data is provided by the originating agencies, not generated by us, and may be delayed, incomplete, inaccurate, or temporarily unavailable due to factors outside our control.

CityTransit should not be relied upon as your sole source of information for time-critical decisions. Always allow extra time, follow posted signage, and verify critical information (such as service disruptions or last departures) directly with the relevant transit agency when it matters.

4. Acceptable Use

By using CityTransit, you agree not to:

  • Use the Service in any way that violates applicable law or regulation;
  • Attempt to scrape, reverse-engineer, or extract data from the Service at scale, or interfere with its normal operation (including via bots, denial-of-service attempts, or automated queries beyond normal use);
  • Misrepresent your identity or impersonate any person or entity when contacting us;
  • Use the Service to build a competing product without our written permission.

5. Intellectual Property

The CityTransit name, logo, app design, and original content are owned by Vasani Technologies Inc. and protected by applicable intellectual property laws. Transit agency names, logos, and route data remain the property of their respective agencies and are used to identify the services they operate. We grant you a limited, non-exclusive, non-transferable, revocable license to use CityTransit for your own personal, non-commercial use, subject to these Terms.

6. Third-Party Services

CityTransit may link to or rely on third-party services (such as app stores, mapping providers, or transit agency websites) that we do not control. We are not responsible for the content, accuracy, or practices of any third-party service, and your use of them is governed by their own terms.

7. Ads & Subscriptions

CityTransit is free to download and use, and is supported by advertising from third-party ad networks. See our Privacy Policy for how ad networks and other third parties may collect and use information from your device.

We also offer CityTransit Plus, an optional paid subscription that removes ads and unlocks premium features such as a home screen widget, custom accent color themes and app icons. Subscriptions are billed and managed through the Apple App Store or Google Play, renew automatically until cancelled, and are subject to the billing, cancellation, and refund policies of the store you subscribed through. You can manage or cancel your subscription at any time in your App Store or Google Play account settings.

8. Disclaimer of Warranties

CityTransit is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data displayed will be accurate or current.

9. Limitation of Liability

To the fullest extent permitted by law, Vasani Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including missed connections, delays, or losses arising from your use of or reliance on CityTransit or the data it displays, even if we have been advised of the possibility of such damages.

10. Termination

We may suspend or discontinue your access to CityTransit, in whole or in part, at any time, for any reason, including violation of these Terms. You may stop using CityTransit at any time by uninstalling the app.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “last updated” date below and, where appropriate, notify you through the app or our website. Continued use of CityTransit after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising from these Terms or your use of CityTransit will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
